TEXAS PRIVACY RIGHTS

This page is intended for residents of Texas (“you,” “your,” “consumer”) and provides supplemental information regarding our Privacy Policy. The Texas Data Privacy and Security Act (“TDPSA”) provides consumers who are Texas residents with specific rights regarding their personal data (“Personal Data”).  This includes your right to request access to, a copy of and/or the deletion of your Personal Data collected, used or disclosed by the owner (“we,” “our,” “us,” “Company”) of the website (“Website”) in connection with the Company’s business purposes within the last 12 months preceding the request, with certain exceptions.

The TDPSA defines “Personal Data” as any information, including sensitive data, that is linked or reasonably linkable to an identified or identifiable individual. If Personal Data is collected directly from you, there are some instances where you may have the option to decline providing that information.  However, in some circumstances, choosing not to provide Personal Data may hinder our ability to provide you with the same level of service and overall experience as those who choose to provide Personal Data.

Regardless of which of your rights you choose to exercise, we will take reasonable measures to provide equal services and price regardless of the sharing of Personal Data, in accordance with applicable law.  The TDPSA guarantees you the right not to receive discriminatory treatment for exercising your privacy rights granted by the TDPSA.

Your Rights under TDPSA

Right to Confirm

You have the right to confirm whether or not your Personal Data is being processed and to access such Personal Data.

Right to Correct

You have the right to correct inaccuracies in your Personal Data, taking into account the nature of the Personal Data and the purposes of the processing of such Personal Data.

Right to Delete

You have the right to delete Personal Data concerning you that the Company has collected from you or about you.

Right to Data Portability

When exercising your right to access Personal Data, you have the right to obtain your Personal Data. If the Personal Data is available in a digital format, you may request a copy of the Personal Data that you have previously provided in a portable and to the extent technically feasible, readily usable format that allows you to transmit the data to another controller without hindrance.

Right to Opt Out

You have the right to opt out of the processing of your Personal Data for purposes of: (1) targeted advertising; (2) the sale of personal data; or (3) profiling in furtherance of decisions that produce legal or similarly significant effects concerning you, the consumer. Although we may continue to share your Personal Data with our affiliates or service providers for essential purposes described herein and other such circumstances, your Personal Data will not be processed for the indicated purpose(s) once we have received and processed a verified request from you not to do so.

Right of No Retaliation

The Company will not discriminate against you for exercising any of your rights granted by the TDPSA.  Unless permitted by the TDPSA, we will not:

  • Deny the consumer goods or services.
  • Charge the consumer different prices for goods or services, whether through denying benefits or imposing penalties.
  • Provide a different level or quality of goods or services to the consumer.
  • Suggest the consumer will receive a different price or rate for goods or services, or a different level or quality of goods or services.
  • Retaliate against an employee, applicant for employment or independent contractor for exercising their rights.
  • Threaten the consumer with any of the actions described in this paragraph.

However, the Company may offer you certain financial incentives permitted by the TDPSA that can result in different prices, rates or quality levels.  Any TDPSA-permitted financial incentive the Company offers will reasonably relate to your Personal Data’s value and contain written terms that describe the program’s material aspects.  Participation in a financial incentive program requires your prior opt-in consent, which you may revoke at any time.

We collect Personal Data about you that you specifically and voluntarily provide to us when using the Website, including when you submit your Personal Data when requesting additional information about the services the Company provides and the use of cookies.  Categories of Personal Data we may collect include:

Why We Collect, Process, Use and Share Information and How We Use Your Data

We use and disclose the Personal Data collected for business purposes.  These business purposes include:

  • Providing relevant and personalized marketing messages.
  • Providing consumers with the products and services you purchase or offer to purchase from the Website.
  • Connecting consumers to businesses that provide the consumer-requested goods or services.
  • Developing insights as to consumer interests and trends.
  • Maintaining up-to-date contact information.
  • Building features that will make the services available on the Website easier to use

Our business purposes as identified by the TDPSA include:

  • Auditing interactions with consumers.
  • Performing services on behalf of the business or service provider.

From time to time, we may contact you to request feedback on your experience using the Website, to assist us in improving the Website or to offer special savings or promotions to you, as a Website user.  At its sole discretion, the Company may use your feedback regarding its services in marketing materials and may attribute them to you without revealing your full name or contact information.

How to Exercise Your Rights

If you wish to exercise any of these consumer rights, you will need to submit a request, which must be verified.  If you are unable to do so, you may select an authorized agent to submit a verifiable request on your behalf. We will respond to your verified request within 45 days of receipt. If we need more time to process your verified request, we will notify you of the extension lasting up to 45 additional days. We will not discriminate against you for exercising any of the consumer rights described herein. You may make request to exercise your rights up to two times per year, free of charge.  The Company reserves the right to assess a fee for excessive requests.

Verification Process

If you have an account on the Website, you will be required to know your username and password as part of the verification process.  Whether or not you have an account on the Website, you may be required to provide additional information in order to confirm your identity and verify the request.   This is done to safeguard your Personal Data against fraudulent requests.

Depending on the rights being exercised and the amount of detail requested, we may require a varying amount of information to be disclosed in order to verify the request.  Any additional information collected will be for the sole purpose of verification and will not be sold or disclosed.

Material Changes to This Notice

The Company reserves the right to modify or amend this Notice and its Privacy Policy without notice at any time and for any reason at its sole discretion.  When material changes to this Notice are made, the “Updated” date will be modified to reflect the date those material changes were made.
